User Testing and Market Research Privacy Policy

This User Testing and Market Research Privacy Policy (“Policy”) explains how information is collected, used, and disclosed by Understood for All, Inc. (“Understood,” “we,” or “us”), in connection with participation by you and/or your child in user testing and market research studies for Understood (each a “Study”). All references to the term "you" or "parent" in this Policy shall include legal guardians, and all references to "children" or "child" shall mean children under 13 years of age.  

We may change this Policy from time to time. If we make changes, we will notify you by revising the date at the Policy and, in some cases (such as for material changes), we will provide you with additional notice (such as adding a statement to our websites' homepages or sending you a notification).

What Information Do We Directly Collect?

We collect information you or your child provide directly to us in connection with the Study.  For example: 

  • We record the Study sessions and collect information you or your child may provide to us in connection with such sessions. This includes the audio/video recordings of the Study session, which may capture you and your child’s interactions and responses in connection therewith and any verbal and non-verbal feedback provided during the Study.

  • From parents only, we may collect your contact information, such as your name and email address, and your child’s first name and age.  We may also collect demographic and other screening information about you and your child.

Information Collected from Other Sources 

We may also obtain information from other sources and combine that with information we collect through the Study. For example, if you were recruited for a Study by a third Party (a ”Recruiter”), we may obtain contact information and demographic and other screening information about you and your child from the Recruiter. Note that any information you provide directly to any Recruiter is provided directly to them and is governed by the privacy policy of such Recruiter. You should carefully review the privacy policy of the Recruiter before you provide any information to them. We are not responsible or liable in any manner for the privacy practices and policies of any Recruiters.

How Do We Use Information About You?

The information we collect will be used to conduct the Study, to evaluate product concepts and gain insights into participant reactions, and for other testing, market research, analysis and internal purposes, including to: 

  • Understand the areas in life that are challenging for you and/or your child to inform product design; 

  • Understand initial reactions to new design and product ideas;

  • Identify areas for improvement in our products and services;

  • Otherwise improve our products, services, and product testing.

We may also use the information we collect about you to: 

  • Screen participants for the Study;

  • Contact you regarding your participation in the Study;

  • Respond to your questions and comments;

  • Monitor and analyze trends, usage and activities in connection with the Study and our products and services;

  • Carry out any other purpose described to you at the time the information was collected or in this Policy;

  • Contact you regarding optional, non-research opportunities; and

  • Contact you regarding optional future user testing or market research opportunities.

Personal information we collect about you or your child will not be used for marketing, advertising, or any external purpose not related to the Study or otherwise specified above. However, aggregated, anonymized, de-identified, or other non-personal information, such as quotes from the Study sessions or other feedback that do not contain any personal information, may be used for any purpose.

How Do We Disclose the Information We Collect?

We may disclose information about you as follows and as otherwise described in this Policy:

  • With vendors, consultants, and other service providers who need access to such information to carry out work on our behalf (including third-party software tools used for data processing and analysis);

  • When we believe in good faith that we are required to do so or that doing so is reasonably necessary or appropriate to comply with any law or legal processes or requirements or respond to lawful requests or legal authorities, including responding to lawful subpoenas, warrants, or court orders;

  • When we believe in good faith that we are required to do so, or that doing so is reasonably necessary or appropriate, to protect the rights, property, or safety of, Understood, our users, our testing participants, third parties, or the public, including if we learn or believe that you, your child, or someone else may be subject to abuse, neglect, or other risk of harm (e.g., we may contact a mental health professional or call 911 or other authorities);

  • In connection with, or during negotiations of, any merger, sale of company assets, or acquisition of all or a portion of our business by another company; and

  • With your consent or at your direction.

We may also disclose aggregated, anonymized, or de-identified information, which cannot reasonably be used to identify you.

Note that we may conduct the Study through third party video conferencing platforms and that such platforms may collect information in connection with your use of the platform. Such collection is governed by the privacy policy of such platform, and you should carefully review the privacy policy of such platform before use. We are not responsible for the privacy practices and policies of such platforms.  

This following provides information about how we collect, use, and disclose information we collect from children in connection with the Study and will control over any conflicting provisions in earlier sections of this Policy. All references to "children" or "child" shall mean children under 13 years of age, and all references to the term "parent" shall include legal guardians.

What personal information do we collect from children?

The only personal information we collect directly from your child in connection with the Study is the audio or video recordings of the Study session, which includes your child’s interactions and responses made during the testing session (and any personal information your child may mention in such recordings). Your child will not have independent access to the recordings and will not be able to make the recordings available to third parties. Please note, however, that if your child participates in a group session, then other participants will, of course, be aware of any information your child shares in the session.

How do we use personal information collected from children?

Any personal information we collect from your child will be used solely for product and marketing research and analysis purposes, such as to evaluate and improve the product concept, gain insights, and for other research and analysis purposes including.to: 

  • Understand the areas in life that are challenging for your child to inform product design;

  • Understand initial reactions to  new design and product ideas;

  • Identify areas for improvement in our products and services; and

  • Otherwise improve our products, services, and product testing.

Note that we may use quotes we collect from your child in connection with a Study for any purpose, but only if they are anonymized and do not contain any personal information. 

What are our disclosure practices regarding personal information obtained from children?

We do not disclose any personal information obtained from your child, other than to vendors, consultants, and other service providers who need access to such information to carry out work on our behalf (including third-party software tools used for secure data processing and analysis), as required by law, or as otherwise specifically provided in this Policy. This may include taking action if we learn or believe that you, your child, or someone else may be subject to abuse, neglect, or other risk of harm (e.g., we may contact a mental health professional or call 911 or other authorities). 

Deletion Requests

As a parent or guardian, you may request to review, or that we delete, any personal information we collect from your child in connection with the Study and that is retained by us. To make such a request, please contact us at knowledge@understood.org.
